The e-commerce website of House of Bamboo, a sole proprietorship with registered office in Kortenberg, VAT BE0701918724 offers its customers the opportunity to purchase products from its online store online. These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the houseofbamboo.be webshop, the Customer must explicitly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by House of Bamboo.

 

Price

 

All prices stated are expressed in EURO, always including VAT and all other taxes or taxes that are obligatory to be borne by the Customer. The price indication refers only to the articles as it is verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind House of Bamboo. House of Bamboo is only bound to an obligation of means as to the accuracy and completeness of the information provided. House of Bamboo is in no way liable in the event of manifest material errors, typesetting or printing errors.

 

Online purchases

House of Bamboo is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.

 

House of Bamboo will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services. Items ordered through this webshop are delivered in Benelux, Europe and Worldwide.

The delivery is by post and the shipping costs are € 2.99 for Benelux and € 5.95 within the EU. From € 75 we offer free shipping in the Benelux. Unless otherwise agreed or expressly determined otherwise, the goods are delivered to the Client’s place of residence within 30 days of receipt of the order. Any visible damage and / or qualitative shortcoming of an article or other shortcoming in the delivery must be immediately reported by the Customer to House of Bamboo. The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier, has physically taken possession of the goods. However, the risk already transfers to the Customer upon delivery to the carrier , if the carrier has been instructed by the Customer to transport the goods and House of Bamboo did not offer this choice.

Retention of title

 

The delivered items remain the exclusive property of House of Bamboo until the moment of full payment by the Customer. If necessary, the Customer undertakes to inform third parties of the retention of title of House of Bamboo, for example to anyone who would seize the items that have not yet been paid in full.

 

The deliveries from the seller are made via partner Bpost / PostNL / DHL in Belgium / Europe and Worldwide. House of Bamboo cannot be held responsible for delays during shipping by Bpost, DHL or PostNL. In accordance with the law of 6/4/2010, the maximum delivery time is thirty days, unless agreed otherwise. If this delivery period is not feasible, the seller must notify the buyer in a timely manner and the buyer has the right to cancel the order, at no additional cost. Any amounts already paid will in that case be refunded within thirty days.

 

Properties

 

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from House of Bamboo.

 

Right of withdrawal

 

In accordance with the law of 6/4/2010, the buyer has 14 days to return the purchase of products from the seller. However, House of Bamboo offers a 30-day reflection period. The buyer must always inform the seller in writing or by e-mail, info@houseofbamboo.be and return the refused products to the seller at the buyer’s expense. The buyer returns the products in a sturdy package, in undamaged and unused condition, together with written proof of purchase. Under no circumstances will unreported or insufficiently stamped returns be credited. Custom-made / engraved cases and / or watches and custom wooden accessories cannot be returned.

 

The Customer cannot exercise the right of withdrawal for: the supply or provision of goods or services whose price is subject to fluctuations in the financial market on which House of Bamboo has no influence and which may occur within the withdrawal period; the delivery of goods manufactured according to the Customer’s specifications, such as personalized accessories, covers, watches and cases, or which are clearly intended for a specific person; the supply of sealed audio and sealed video recordings and sealed computer software of which the seal has been broken after delivery; the delivery of digital content that has not been delivered on a tangible medium, if the execution has started with the express prior consent of the Customer and provided that the Customer has acknowledged that he thereby loses his right of withdrawal (eg downloading music, software);

 

Guarantee

 

Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, consumers have statutory rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty is without prejudice to these rights. To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the Customer’s home, Customer must contact House of Bamboo customer service and return the item to House of Bamboo at his expense. If a defect is found, the Customer must inform House of Bamboo as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. Afterwards, any right to repair or replacement lapses. The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or changes to the item, heavy use, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless the Client proves otherwise.

Defects that manifest themselves after a period of 6 months from the date of purchase, if applicable delivery, are considered not to be hidden defects, unless the Customer proves the contrary.
